IMPORTANT: SECTION 28 CONTAINS A BINDING INDIVIDUAL ARBITRATION AGREEMENT AND A CLASS ACTION WAIVER. BLOCKCHAIN TRANSACTIONS ARE FINAL — ONCE SIGNED AND CONFIRMED THEY CANNOT BE REVERSED BY ANYONE, INCLUDING BSAZEV. YOU ARE SOLELY RESPONSIBLE FOR EVERYTHING YOU SIGN WITH YOUR WALLET.

1. Overview and acceptance

BSAZEV (“BSAZEV”, “we”, “us”) operates bsazev.com and the related products: the FOW Pro and FOW One trading software, FOW Swap (swaps, limit orders and cross-chain transfers), BSA Reclaim, the FOW Trading Desk game, Telegram alerts and the client area (together, the “Services”).

By accessing or using any of the Services you confirm that you have read, understood and agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Services.

2. Eligibility

  • You are at least 18 years old, or the age of majority where you live, whichever is higher.
  • You are not located in, or a resident of, a country or region under comprehensive sanctions, and you are not on any sanctions or restricted-party list (such as the U.S. OFAC SDN list, or the UK, EU or UN lists), nor acting for anyone who is.
  • Using the Services is legal where you are, and you have not been previously blocked from them.

We may restrict or block access to any of the Services at any time and for any reason. We do not screen wallets or IP addresses against sanctions lists in real time; complying with the laws that apply to you is your responsibility.

Using a VPN, proxy or any other method to hide your location or get around these restrictions is prohibited. We may limit or switch off features in specific countries or regions at any time.

3. Your legal and tax obligations

You alone are responsible for complying with the laws that apply to your use of the Services, including anti-money-laundering, securities, tax and financial regulations. You are responsible for declaring and paying any taxes on your trades, swaps, recovered SOL and any other result of using the Services. We do not provide tax reporting or advice.

Where we consider it necessary, or where the law requires it, we may ask for information or documents to verify your identity or the origin of funds, and we may restrict access until they are provided or if there are signs of money laundering, terrorist financing, fraud or other illegal activity.

4. Client area account

You sign in to the client area with a wallet signature; no password is created. You are responsible for every action taken with your account and for the accuracy of the information you give us (name, email, trading wallet). Tell us right away at support@bsazev.com if you believe someone else has accessed your account. We may suspend accounts with false or incomplete information.

5. Non-custodial services

The Services are non-custodial. We never hold, control or have access to your funds or private keys. Every transaction is signed by you, either in your own wallet (FOW Swap, BSA Reclaim, purchases) or on your own computer (FOW Pro and FOW One). We cannot cancel, reverse or change a transaction after you sign it. Some signed transactions may be relayed to the Solana network through RPC infrastructure that we operate or use.

We are not a broker, dealer, exchange, investment adviser, bank or money services business, and we do not act as your agent or fiduciary.

6. FOW Pro and FOW One licenses

  • A license lasts 365 days from the final confirmation of the payment on the Solana network.
  • A license is personal and works on one machine at a time. You can request a machine change from the software or from the client area; it is approved by support after ownership and fraud checks.
  • Licenses may not be shared, sublicensed or resold without our written permission.
  • You may buy a license for someone else by entering their login wallet at checkout. The person who paid is the buyer (and the one refunded, if a refund applies); the person who received it is the authorized user.
  • There is no automatic renewal. Buying another year before expiry adds 365 days to the current expiry date.

The software acts only on the parameters you set: you choose the pairs, amounts, targets and protections, and every trade it sends follows those settings. You can stop any bot at any time; orders already sent to the network may still be confirmed. You are responsible for any profit or loss.

7. Payments

  • Prices are shown before you pay. Payment is made in SOL or USDT on the Solana network, to the sales address shown on the payment screen.
  • SOL amounts are quoted at the start of the payment and are valid for 15 minutes.
  • Always check the asset, network, address and amount in your wallet before approving. Transfers to other addresses, networks or assets may be impossible to recover.
  • The license is issued automatically after the payment is confirmed. Payments that are short, late or cannot be matched to an order are handled by support, who will offer to complete the purchase or refund the amount received.
  • We will never ask for your private key or recovery phrase to confirm a payment.

8. Fees

We earn revenue from the Services. Fees are always charged inside the same on-chain transaction as the operation, so a transaction that fails on the network is reverted and no service fee is taken (you only pay the Solana network fee for the attempt).

  • FOW Pro / FOW One: a usage fee of 0.5% on the buys and sells the software executes, in addition to the license price. Wallet-tab swaps carry the same 0.5%; withdrawals carry no fee.
  • FOW Swap: a platform fee is included in the quote you see; the amount you receive is shown before you sign.
  • BSA Reclaim: a service fee is deducted from the SOL recovered. The amount displayed before you sign is the net amount that reaches your wallet.

Network fees, priority fees, relay tips and fees of third-party protocols are set by the network or by those third parties, not by us. We may change our fees at any time; changes never apply to transactions already completed. Deliberately bypassing a fee or the licensing (for example with a modified binary) is a material breach of these Terms.

Network fees and amounts shown before signing are estimates and can differ slightly from the final result, because prices, network conditions and third-party protocols change between the estimate and the confirmation.

9. FOW Swap

Quotes and routes come from third-party aggregators and bridges (such as Jupiter, KyberSwap, 0x and Relay). They operate independently of us and under their own terms. Swaps are subject to slippage, price impact, insufficient liquidity, route failures and third-party smart contract risk. The site checks each transaction before your wallet opens it, but we do not guarantee any price or result. Limit orders may never execute.

10. BSA Reclaim

BSA Reclaim closes token accounts in your wallet that have a zero balance and returns their rent deposit to your wallet. It does not burn, move or sell any token or NFT. Closing an account does not stop you from receiving that token again — a new account is created automatically when needed. The amounts shown are estimates based on on-chain data at the time of the scan; we do not guarantee that any amount will be recovered.

11. FOW Trading Desk game

The game is for entertainment only. Coins, upgrades, rankings and rewards inside the game have no monetary value, cannot be bought, sold or withdrawn, and do not affect your licenses or trades. We may reset, change or end the game at any time.

The game is not gambling: there are no wagers, deposits, prizes in money or digital assets, or games of chance with real value.

12. Telegram alerts

Alerts are optional and sent on a best-effort basis through Telegram, an independent service. They may be delayed, incomplete or not delivered. Never rely on an alert as the only way to follow your positions.

13. Promotions and referrals

We may offer promotions, discounts, referral or reward programs. Each program has its own rules, published when it is offered. We may change, pause or end any program at any time, and we may cancel rewards obtained through fake accounts, self-referrals, spam or any other abuse. Rewards may be taxable where you live; that is your responsibility.

14. Wallet and computer security

You are responsible for your private keys, recovery phrases, passwords, devices and software. FOW Pro stores keys encrypted on your computer behind your unlock password; that protection also depends on the security of your computer. Only install FOW Pro from the official channels. We are not affiliated with any wallet provider (such as Phantom, Solflare or Backpack) and are not responsible for wallet software, browser extensions, phishing, malware or approvals you give. Our team will never ask for your private key or recovery phrase.

If you lose your private key or recovery phrase, or forget the unlock password of FOW Pro, we cannot recover them or your funds — keep your own secure backups. Anyone with your keys can move your assets. You are also responsible for the equipment, operating system and internet connection you use.

15. License server dependency

FOW Pro checks its license with our server about every 5 minutes. If it cannot reach the server for more than 2 hours, it stops all buy and sell operations until the connection returns, and it cannot be activated while the server is unreachable. Your funds stay in your wallet and remain accessible with any compatible wallet. FOW Pro must therefore not be treated as a guaranteed exit or stop-loss mechanism during outages.

16. Assumption of risk

You understand and accept the risks of crypto assets and blockchain software, including:

  • extreme price volatility and the partial or total loss of the capital you use;
  • slippage, failed or delayed transactions, insufficient liquidity, rug pulls and manipulated or malicious tokens;
  • bugs or unexpected behavior in our software or in third-party programs, DEXes, aggregators and bridges;
  • outages or degraded performance of the Solana network, validators, RPC providers, relays and other infrastructure;
  • changes to network rules (including rent and fees) and to the laws that apply to you.

Our software is not audited by a third party. Use of the Services is at your own risk.

  • forks, sudden changes to blockchain rules and attacks on networks (such as double spending);
  • counterfeit, mislabeled or impersonating tokens, tokens with broken metadata and tokens that become untransferable;
  • beta or experimental features, which may contain more errors than the rest of the Services.

Digital assets are not bank deposits and are not insured or guaranteed by any government agency or deposit-protection scheme.

17. No advice and no guarantee of results

Nothing in the Services, on the site or from support is financial, investment, legal or tax advice. Features that automate or calculate targets only apply the settings you choose. We do not guarantee profit, any price, execution speed, that a transaction will be confirmed, or that estimates and amounts shown are exact.

Do not use the Services expecting profit or a return from the efforts of BSAZEV or anyone else. Many tokens traded on Solana have no use or value at all, and you may lose everything you put into them. Nothing in the Services is an offer or solicitation to buy or sell any asset.

18. Updates and support

Licenses include updates for their whole term. Updates are digitally signed and verified by the software before installing. Support is provided at support@bsazev.com and on our official Discord. We may add, change or remove features; important changes during an active license are announced.

19. Prohibited conduct

  • breaking the law, financing illegal activity or laundering money through the Services;
  • bypassing fees, licensing, access restrictions or geographic limits;
  • copying, cracking, modifying or redistributing the software, or reverse engineering it except where the law expressly allows;
  • attacking, overloading or exploiting the Services, or using bots or scripts against them in unauthorized ways;
  • impersonating BSAZEV or anyone else, or abusing promotions, referrals or the game.
  • wash trading, pump-and-dump schemes, front-running, spoofing or any other manipulative or deceptive trading;
  • using the Services for activities that require a financial license you do not have, such as offering securities or managing third-party money;
  • using another person’s wallet or account without permission, or giving us false information;
  • creating another wallet or account to get back in after being blocked.

20. Intellectual property

The Services, the software, the site, the FOW and BSAZEV names and logos and all related content belong to BSAZEV. We grant you a limited, personal, non-exclusive, non-transferable and revocable right to use the Services according to these Terms. Feedback you send us may be used freely, without obligation to you.

If you believe something on the Services infringes your copyright or trademark, write to support@bsazev.com with: the work concerned, where the material appears (URL), your contact details, a statement of good faith that the use is not authorized, and a statement that the information is accurate and that you are the owner or authorized to act for them.

21. Third-party services and links

The Services connect to, display or link to third-party services — wallets, RPC providers, relays, DEXes, aggregators, bridges, data providers, explorers, Telegram and others. We do not control, endorse or guarantee them, and we are not responsible for their content, availability, fees, security or data practices. Your use of them is at your own risk and governed by their own terms. When you leave our site, these Terms no longer apply.

22. Suspension and termination

We may suspend or end your access to the Services, or a license, in case of fraud, a security risk, unlawful use or a breach of these Terms. Whenever reasonably possible we will tell you the reason and give you a chance to respond. You may stop using the Services at any time and delete your account in the client area.

23. Refunds

You may request a full refund within 7 days of a license purchase by writing to support@bsazev.com. The amount in US dollars recorded in the order is returned in the asset you paid with, at the market rate on the day of the refund, and we pay the network fee. After 7 days there is no refund for change of mind. Payments sent to the wrong address, network or asset are reviewed case by case.

24. Disclaimer of warranties

THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE”, WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE OR SECURE, OR THAT ANY INFORMATION SHOWN (PRICES, BALANCES, ESTIMATES, FEES) IS ACCURATE OR CURRENT.

25. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, BSAZEV AND ITS OWNERS, EMPLOYEES, CONTRACTORS AND AFFILIATES ARE NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR FOR LOSS OF FUNDS, DIGITAL ASSETS, PROFITS, DATA OR GOODWILL, ARISING FROM THE USE OF THE SERVICES.

OUR TOTAL LIABILITY FOR ALL CLAIMS IS LIMITED TO THE GREATER OF (I) THE AMOUNTS YOU PAID US IN THE 6 MONTHS BEFORE THE CLAIM, OR (II) US$ 100. Where the law does not allow some of these limitations, they apply to the maximum extent permitted.

These limitations do not apply to liability for fraud or for anything that the law does not allow to be limited. They are an essential part of the agreement between you and us and are reflected in the prices we charge.

26. Indemnification

You agree to defend and indemnify BSAZEV against claims, losses and expenses (including reasonable legal fees) arising from your use of the Services, your breach of these Terms or of any law, or any transaction you sign.

27. Force majeure

We are not responsible for delays or failures caused by events beyond our reasonable control, including natural disasters, war, internet or infrastructure failures and blockchain network disruptions.

28. Disputes and arbitration

Before starting any formal claim, write to support@bsazev.com describing the issue; we will try in good faith to solve it within 30 days.

If it is not solved, any dispute related to these Terms or the Services will be resolved by final and binding individual arbitration, conducted in English, rather than in court. You and BSAZEV each waive the right to a jury trial and to take part in any class, collective or representative action. A claim must be filed within 1 year of the facts that gave rise to it. Either party may still seek urgent injunctive relief in court or protect its intellectual property.

Claims that qualify for a small-claims court may be brought there on an individual basis. Arbitration proceedings and documents are confidential. If 50 or more similar claims are filed by or with the help of the same lawyers or organizers, they will be decided in batches, with one arbitrator per batch, to keep costs reasonable for everyone.

You may opt out of this arbitration agreement by writing to support@bsazev.com within 30 days of first accepting these Terms. If you opt out, we are not bound by it either; the class action waiver still applies to the extent the law allows.

29. Governing law

These Terms are governed by the laws of the jurisdiction where BSAZEV is incorporated, without regard to conflict-of-laws rules, which will also be the seat of the arbitration.

30. General

We may update these Terms by publishing a new version with a new date; continued use means acceptance, and changes do not apply to transactions already completed. These Terms are the entire agreement between you and us about the Services. If a provision is invalid, the rest remains in force. Not enforcing a provision is not a waiver. You may not transfer your rights under these Terms; we may transfer ours, including in a merger or sale. If translations differ, the English version prevails. You agree to receive notices and communications electronically — on the site, in the client area or by email — and that they count as written notice. Material changes to these Terms will be announced at least 30 days before they apply to existing users, except changes required by law or for security. Sections that by their nature should survive (fees owed, intellectual property, disclaimers, limitation of liability, indemnification and disputes) remain in force after your use ends.

1. Visão geral e aceite

A BSAZEV (“BSAZEV”, “nós”) opera o bsazev.com e os produtos relacionados: os softwares de trading FOW Pro e FOW One, o FOW Swap (swaps, ordens limitadas e transferências entre redes), o BSA Reclaim, o jogo FOW Trading Desk, os alertas no Telegram e a área do cliente (juntos, os “Serviços”).

Ao acessar ou usar qualquer um dos Serviços, você confirma que leu, entendeu e concorda com estes Termos e com a nossa Política de Privacidade. Se não concordar, não use os Serviços.

2. Quem pode usar

  • Você tem pelo menos 18 anos, ou a maioridade do lugar onde mora, o que for maior.
  • Você não está nem reside em país ou região sob sanções amplas, e não consta em listas de sanções ou de restrição (como a lista SDN da OFAC dos EUA ou as listas do Reino Unido, da UE ou da ONU), nem age em nome de quem conste.
  • Usar os Serviços é permitido onde você está, e você não foi bloqueado deles antes.

Podemos restringir ou bloquear o acesso a qualquer Serviço a qualquer momento e por qualquer motivo. Não verificamos carteiras ou IPs contra listas de sanções em tempo real; cumprir as leis que se aplicam a você é responsabilidade sua.

É proibido usar VPN, proxy ou qualquer outro meio para esconder sua localização ou contornar estas restrições. Podemos limitar ou desligar recursos em países ou regiões específicos a qualquer momento.

3. Suas obrigações legais e fiscais

Só você é responsável por cumprir as leis que se aplicam ao seu uso dos Serviços, incluindo regras de prevenção à lavagem de dinheiro, valores mobiliários, impostos e regulação financeira. Você é responsável por declarar e pagar os impostos sobre seus trades, swaps, SOL recuperado e qualquer outro resultado do uso dos Serviços. Não fazemos declarações nem damos orientação fiscal.

Quando julgarmos necessário, ou quando a lei exigir, podemos pedir informações ou documentos para verificar sua identidade ou a origem dos recursos, e podemos restringir o acesso até que sejam enviados ou se houver indícios de lavagem de dinheiro, financiamento ao terrorismo, fraude ou outra atividade ilegal.

4. Conta na área do cliente

Você entra na área do cliente assinando com a carteira; nenhuma senha é criada. Você é responsável por toda ação feita com a sua conta e pela exatidão das informações que nos dá (nome, e-mail, carteira de trading). Avise imediatamente pelo support@bsazev.com se achar que outra pessoa acessou sua conta. Podemos suspender contas com informações falsas ou incompletas.

5. Serviços sem custódia

Os Serviços não têm custódia. Nunca guardamos, controlamos nem temos acesso aos seus fundos ou chaves privadas. Toda transação é assinada por você, na sua própria carteira (FOW Swap, BSA Reclaim, compras) ou no seu próprio computador (FOW Pro e FOW One). Não conseguimos cancelar, reverter nem alterar uma transação depois que você a assina. Algumas transações assinadas podem ser repassadas à rede Solana por infraestrutura de RPC que operamos ou usamos.

Não somos corretora, distribuidora, exchange, consultoria de investimentos, banco nem empresa de serviços financeiros, e não agimos como seu representante ou fiduciário.

6. Licenças do FOW Pro e do FOW One

  • A licença vale 365 dias a partir da confirmação final do pagamento na rede Solana.
  • A licença é pessoal e funciona em uma máquina por vez. A troca de máquina é pedida pelo software ou pela área do cliente e aprovada pelo suporte após checagens de titularidade e de fraude.
  • A licença não pode ser compartilhada, sublicenciada nem revendida sem nossa autorização por escrito.
  • Você pode comprar uma licença para outra pessoa informando a carteira de login dela na compra. Quem pagou é o comprador (e quem recebe um eventual reembolso); quem recebeu é o usuário autorizado.
  • Não há renovação automática. Comprar mais um ano antes do vencimento soma 365 dias à data de vencimento atual.

O software age só pelos parâmetros que você define: você escolhe os pares, valores, alvos e proteções, e todo trade enviado segue essas configurações. Você pode parar qualquer bot a qualquer momento; ordens já enviadas à rede ainda podem ser confirmadas. O lucro ou o prejuízo é responsabilidade sua.

7. Pagamentos

  • Os preços aparecem antes do pagamento. O pagamento é feito em SOL ou USDT na rede Solana, para o endereço de vendas mostrado na tela de pagamento.
  • O valor em SOL é cotado no início do pagamento e vale por 15 minutos.
  • Confira sempre o ativo, a rede, o endereço e o valor na carteira antes de aprovar. Transferências para outros endereços, redes ou ativos podem ser impossíveis de recuperar.
  • A licença é emitida automaticamente após a confirmação do pagamento. Pagamentos a menor, atrasados ou que não possam ser ligados a um pedido são tratados pelo suporte, que oferecerá completar a compra ou devolver o valor recebido.
  • Nunca pediremos sua chave privada ou frase de recuperação para confirmar um pagamento.

8. Taxas

Os Serviços geram receita para nós. As taxas são sempre cobradas dentro da mesma transação on-chain da operação; por isso, uma transação que falha na rede é revertida e nenhuma taxa de serviço é cobrada (você só paga a taxa da rede Solana pela tentativa).

  • FOW Pro / FOW One: taxa de uso de 0,5% sobre as compras e vendas que o software executa, além do preço da licença. Swaps na aba Wallet têm os mesmos 0,5%; saques não têm taxa.
  • FOW Swap: uma taxa de plataforma já está incluída na cotação; o valor que você recebe aparece antes de assinar.
  • BSA Reclaim: uma taxa de serviço é descontada do SOL recuperado. O valor mostrado antes de assinar é o valor líquido que chega na sua carteira.

Taxas da rede, de prioridade, gorjetas de relays e taxas de protocolos de terceiros são definidas pela rede ou por esses terceiros, não por nós. Podemos mudar nossas taxas a qualquer momento; as mudanças nunca valem para transações já concluídas. Burlar deliberadamente uma taxa ou o licenciamento (por exemplo, com um binário modificado) é violação grave destes Termos.

As taxas de rede e os valores mostrados antes de assinar são estimativas e podem diferir um pouco do resultado final, porque preços, condições da rede e protocolos de terceiros mudam entre a estimativa e a confirmação.

9. FOW Swap

Cotações e rotas vêm de agregadores e pontes de terceiros (como Jupiter, KyberSwap, 0x e Relay), que operam de forma independente e sob seus próprios termos. Swaps estão sujeitos a slippage, impacto no preço, falta de liquidez, falhas de rota e riscos de contratos de terceiros. O site confere cada transação antes de a carteira abri-la, mas não garantimos preço nem resultado. Ordens limitadas podem nunca ser executadas.

10. BSA Reclaim

O BSA Reclaim fecha contas de token da sua carteira que estão com saldo zero e devolve o depósito de aluguel delas para a sua carteira. Ele não queima, move nem vende nenhum token ou NFT. Fechar uma conta não impede você de receber aquele token de novo — uma conta nova é criada automaticamente quando preciso. Os valores mostrados são estimativas com base nos dados on-chain no momento da leitura; não garantimos que algum valor será recuperado.

11. Jogo FOW Trading Desk

O jogo é apenas entretenimento. Moedas, melhorias, rankings e prêmios dentro do jogo não têm valor monetário, não podem ser comprados, vendidos nem sacados, e não afetam suas licenças ou trades. Podemos zerar, mudar ou encerrar o jogo a qualquer momento.

O jogo não é aposta: não há apostas, depósitos, prêmios em dinheiro ou ativos digitais, nem jogos de azar com valor real.

12. Alertas no Telegram

Os alertas são opcionais e enviados sem garantia de entrega pelo Telegram, um serviço independente. Podem atrasar, chegar incompletos ou não chegar. Nunca dependa só de um alerta para acompanhar suas posições.

13. Promoções e indicações

Podemos oferecer promoções, descontos, programas de indicação ou de recompensa. Cada programa tem regras próprias, publicadas quando for oferecido. Podemos mudar, pausar ou encerrar qualquer programa a qualquer momento, e cancelar recompensas obtidas com contas falsas, autoindicação, spam ou qualquer outro abuso. As recompensas podem ser tributáveis onde você mora; isso é responsabilidade sua.

14. Segurança da carteira e do computador

Você é responsável por suas chaves privadas, frases de recuperação, senhas, dispositivos e programas. O FOW Pro guarda as chaves criptografadas no seu computador, protegidas pela sua senha de desbloqueio; essa proteção também depende da segurança do computador. Instale o FOW Pro só pelos canais oficiais. Não temos ligação com nenhuma carteira (como Phantom, Solflare ou Backpack) e não respondemos por software de carteira, extensões de navegador, phishing, malware ou aprovações que você der. Nossa equipe nunca pedirá sua chave privada ou frase de recuperação.

Se você perder a chave privada ou a frase de recuperação, ou esquecer a senha de desbloqueio do FOW Pro, não conseguimos recuperá-las nem recuperar seus fundos — guarde seus próprios backups seguros. Quem tiver suas chaves pode mover seus ativos. Você também é responsável pelo equipamento, sistema operacional e conexão de internet que usa.

15. Dependência do servidor de licenças

O FOW Pro confere a licença com o nosso servidor a cada cerca de 5 minutos. Se ficar mais de 2 horas sem conseguir falar com o servidor, ele para todas as compras e vendas até a conexão voltar, e não pode ser ativado enquanto o servidor estiver fora. Seus fundos continuam na sua carteira e podem ser acessados por qualquer carteira compatível. Por isso o FOW Pro não deve ser tratado como mecanismo garantido de saída ou stop loss durante quedas.

16. Aceitação de riscos

Você entende e aceita os riscos de criptoativos e de software de blockchain, incluindo:

  • volatilidade extrema de preço e perda parcial ou total do capital usado;
  • slippage, transações que falham ou atrasam, falta de liquidez, rug pulls e tokens manipulados ou maliciosos;
  • bugs ou comportamento inesperado no nosso software ou em programas, DEXes, agregadores e pontes de terceiros;
  • quedas ou lentidão da rede Solana, validadores, provedores de RPC, relays e outras infraestruturas;
  • mudanças nas regras da rede (incluindo aluguel e taxas) e nas leis que se aplicam a você.

Nosso software não foi auditado por terceiros. O uso dos Serviços é por sua conta e risco.

  • forks, mudanças repentinas nas regras da blockchain e ataques às redes (como gasto duplo);
  • tokens falsificados, com nome enganoso ou que imitam outros, tokens com metadados quebrados e tokens que deixam de poder ser transferidos;
  • recursos beta ou experimentais, que podem ter mais erros que o resto dos Serviços.

Ativos digitais não são depósitos bancários e não têm seguro nem garantia de nenhum órgão do governo ou fundo garantidor.

17. Sem recomendação e sem garantia de resultado

Nada nos Serviços, no site ou no suporte é recomendação financeira, de investimento, jurídica ou fiscal. Recursos que automatizam ou calculam alvos só aplicam as configurações que você escolhe. Não garantimos lucro, preço, velocidade de execução, que uma transação será confirmada, nem que estimativas e valores mostrados sejam exatos.

Não use os Serviços esperando lucro ou retorno pelo esforço da BSAZEV ou de qualquer outra pessoa. Muitos tokens negociados na Solana não têm uso nem valor algum, e você pode perder tudo o que colocar neles. Nada nos Serviços é oferta ou convite para comprar ou vender qualquer ativo.

18. Atualizações e suporte

As licenças incluem atualizações durante toda a vigência. As atualizações são assinadas digitalmente e conferidas pelo software antes de instalar. O suporte é feito pelo support@bsazev.com e pelo nosso Discord oficial. Podemos incluir, mudar ou remover recursos; mudanças importantes durante uma licença ativa são avisadas.

19. Condutas proibidas

  • violar a lei, financiar atividade ilegal ou lavar dinheiro por meio dos Serviços;
  • burlar taxas, licenciamento, restrições de acesso ou limites geográficos;
  • copiar, crackear, modificar ou redistribuir o software, ou fazer engenharia reversa, salvo onde a lei permita expressamente;
  • atacar, sobrecarregar ou explorar falhas dos Serviços, ou usar bots e scripts contra eles sem autorização;
  • se passar pela BSAZEV ou por outra pessoa, ou abusar de promoções, indicações ou do jogo.
  • wash trading, esquemas de pump-and-dump, front-running, spoofing ou qualquer outra negociação manipuladora ou enganosa;
  • usar os Serviços para atividades que exigem licença financeira que você não tem, como oferecer valores mobiliários ou administrar dinheiro de terceiros;
  • usar a carteira ou a conta de outra pessoa sem permissão, ou nos dar informações falsas;
  • criar outra carteira ou conta para voltar depois de ser bloqueado.

20. Propriedade intelectual

Os Serviços, o software, o site, os nomes e logos FOW e BSAZEV e todo o conteúdo relacionado pertencem à BSAZEV. Concedemos a você um direito limitado, pessoal, não exclusivo, intransferível e revogável de usar os Serviços conforme estes Termos. Sugestões que você nos enviar podem ser usadas livremente, sem obrigação com você.

Se achar que algo nos Serviços viola seu direito autoral ou sua marca, escreva para support@bsazev.com com: a obra em questão, onde o material aparece (URL), seus dados de contato, uma declaração de boa-fé de que o uso não é autorizado e uma declaração de que as informações são verdadeiras e de que você é o titular ou está autorizado a agir por ele.

21. Serviços e links de terceiros

Os Serviços se conectam, exibem ou levam a serviços de terceiros — carteiras, provedores de RPC, relays, DEXes, agregadores, pontes, provedores de dados, exploradores, Telegram e outros. Não controlamos, não endossamos nem garantimos esses serviços, e não respondemos pelo conteúdo, disponibilidade, taxas, segurança ou tratamento de dados deles. O uso é por sua conta e risco e segue os termos de cada um. Ao sair do nosso site, estes Termos deixam de valer.

22. Suspensão e encerramento

Podemos suspender ou encerrar seu acesso aos Serviços, ou uma licença, em caso de fraude, risco de segurança, uso ilegal ou violação destes Termos. Sempre que possível, informaremos o motivo e daremos chance de resposta. Você pode parar de usar os Serviços a qualquer momento e excluir sua conta na área do cliente.

23. Reembolsos

Você pode pedir reembolso integral em até 7 dias da compra de uma licença, escrevendo para support@bsazev.com. O valor em dólares registrado no pedido é devolvido no ativo usado no pagamento, pela cotação do dia do reembolso, e nós pagamos a taxa da rede. Depois de 7 dias não há reembolso por desistência. Pagamentos enviados para endereço, rede ou ativo errados são analisados caso a caso.

24. Isenção de garantias

OS SERVIÇOS SÃO FORNECIDOS “NO ESTADO EM QUE SE ENCONTRAM” E “CONFORME DISPONÍVEIS”, SEM GARANTIAS DE QUALQUER TIPO, EXPRESSAS OU IMPLÍCITAS, INCLUINDO COMERCIALIZAÇÃO, ADEQUAÇÃO A UM FIM ESPECÍFICO, TITULARIDADE E NÃO VIOLAÇÃO. NÃO GARANTIMOS QUE OS SERVIÇOS SERÃO ININTERRUPTOS, SEM ERROS OU SEGUROS, NEM QUE AS INFORMAÇÕES MOSTRADAS (PREÇOS, SALDOS, ESTIMATIVAS, TAXAS) SEJAM PRECISAS OU ATUAIS.

25. Limitação de responsabilidade

NA MÁXIMA EXTENSÃO PERMITIDA PELA LEI, A BSAZEV E SEUS SÓCIOS, FUNCIONÁRIOS, PRESTADORES E AFILIADAS NÃO RESPONDEM POR DANOS INDIRETOS, INCIDENTAIS, ESPECIAIS, CONSEQUENTES OU PUNITIVOS, NEM POR PERDA DE FUNDOS, ATIVOS DIGITAIS, LUCROS, DADOS OU REPUTAÇÃO DECORRENTES DO USO DOS SERVIÇOS.

NOSSA RESPONSABILIDADE TOTAL POR TODAS AS RECLAMAÇÕES FICA LIMITADA AO MAIOR VALOR ENTRE (I) O QUE VOCÊ NOS PAGOU NOS 6 MESES ANTERIORES À RECLAMAÇÃO E (II) US$ 100. Onde a lei não permitir alguma dessas limitações, elas valem na máxima extensão permitida.

Estas limitações não se aplicam à responsabilidade por fraude nem ao que a lei não permite limitar. Elas são parte essencial do acordo entre você e nós e estão refletidas nos preços que cobramos.

26. Indenização

Você concorda em defender e indenizar a BSAZEV contra reclamações, perdas e despesas (incluindo honorários advocatícios razoáveis) decorrentes do seu uso dos Serviços, da violação destes Termos ou de qualquer lei, ou de qualquer transação que você assinar.

27. Força maior

Não respondemos por atrasos ou falhas causados por eventos fora do nosso controle razoável, incluindo desastres naturais, guerras, falhas de internet ou de infraestrutura e interrupções da rede blockchain.

28. Disputas e arbitragem

Antes de iniciar qualquer reclamação formal, escreva para support@bsazev.com descrevendo o problema; tentaremos resolver de boa-fé em até 30 dias.

Se não for resolvida, qualquer disputa relacionada a estes Termos ou aos Serviços será decidida por arbitragem individual, final e obrigatória, conduzida em inglês, e não na justiça comum. Você e a BSAZEV renunciam ao julgamento por júri e à participação em qualquer ação coletiva ou representativa. A reclamação deve ser apresentada em até 1 ano dos fatos que a originaram. Qualquer parte ainda pode pedir medida urgente na justiça ou proteger sua propriedade intelectual.

Reclamações que se enquadrem em juizado de pequenas causas podem ser levadas a ele, de forma individual. Os procedimentos e documentos da arbitragem são confidenciais. Se 50 ou mais reclamações parecidas forem apresentadas pelos mesmos advogados ou organizadores, ou com a ajuda deles, serão decididas em lotes, com um árbitro por lote, para manter os custos razoáveis para todos.

Você pode sair deste acordo de arbitragem escrevendo para support@bsazev.com em até 30 dias depois de aceitar estes Termos pela primeira vez. Se sair, nós também não ficamos obrigados a ele; a renúncia a ações coletivas continua valendo na medida em que a lei permitir.

29. Lei aplicável

Estes Termos são regidos pelas leis da jurisdição onde a BSAZEV estiver constituída, sem considerar regras de conflito de leis, que também será a sede da arbitragem.

30. Disposições gerais

Podemos atualizar estes Termos publicando uma nova versão com nova data; continuar usando significa aceitar, e as mudanças não valem para transações já concluídas. Estes Termos são o acordo completo entre você e nós sobre os Serviços. Se uma cláusula for inválida, o resto continua valendo. Não exigir uma cláusula não é renúncia. Você não pode transferir seus direitos destes Termos; nós podemos transferir os nossos, inclusive em fusão ou venda. Se as traduções divergirem, vale a versão em inglês. Você concorda em receber avisos e comunicações de forma eletrônica — no site, na área do cliente ou por e-mail — e que eles valem como aviso por escrito. Mudanças relevantes nestes Termos serão avisadas pelo menos 30 dias antes de valerem para quem já usa os Serviços, exceto as exigidas por lei ou por segurança. As cláusulas que por natureza devem continuar (taxas devidas, propriedade intelectual, isenções, limitação de responsabilidade, indenização e disputas) continuam valendo depois que seu uso terminar.
